Terms of Use

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.

2. The Service

Sleep Hush provides relaxation and sleep-support features, including audio content and timers. Feature availability may vary by device, region, and app version.

3. No Medical Advice

Sleep Hush is not a medical device and does not provide medical advice, diagnosis, or treatment. If you have a health concern, including a sleep disorder, consult a qualified healthcare professional.

4. Subscriptions, Free Trials, and Purchases

4.1 Subscription Plans

Sleep Hush offers the following auto-renewable subscription options:

Actual pricing will be displayed in the App at the time of purchase, as set by Apple’s App Store pricing tiers.

4.2 Payment & Billing (Apple App Store)

If you purchase a Subscription through Apple’s in-app purchase system, payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price you initially agreed to.

4.3 Free Trial (7-Day Trial for Yearly Subscription)

If you select the Yearly Subscription, you will receive a 7-day free trial if offered at the time of purchase. During the free trial, you will not be charged. If you do not cancel at least 24 hours before the trial ends, your Subscription will automatically convert to a paid Yearly Subscription, and the full yearly price will be charged to your Apple ID.

Free Trial Eligibility: The free trial is limited to one per user or per Apple ID. If you have previously used a free trial for Sleep Hush, you may not be eligible for another free trial.

Note: The Monthly Subscription does not include a free trial.

4.4 Managing & Canceling Subscriptions

You can manage or cancel your Subscription at any time in your device settings: Settings → Apple ID → Subscriptions

• To avoid being charged for the next billing period, you must cancel at least 24 hours before the current period ends.
• Deleting the App does not cancel your Subscription.

4.5 Price Changes

Subscription prices may change from time to time. If Apple requires notice or consent for a price increase, it will be handled through Apple’s system. Any price change will not affect your current billing period; you will be notified in advance and charged at the new price only upon renewal if you continue the Subscription.

4.6 Refunds

Payments and refunds are handled by Apple (not Sleep Hush) when you purchase through the App Store. Refund requests are subject to Apple’s policies. If you believe you are entitled to a refund, please request it through Apple support or your purchase history.

4.7 Restore Purchases

If you reinstall the App or change devices, you may be able to restore eligible purchases using the “Restore Purchases” option in the App (if available), or through Apple’s account-based restoration mechanisms.

5. License and Acceptable Use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and applicable laws.

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes
• Reverse engineer, decompile, or attempt to discover source code except where permitted by law
• Interfere with the operation, security, or integrity of the Service
• Copy, modify, distribute, sell, or lease any part of the Service unless permitted by us in writing

6. Intellectual Property

The Service, including audio, artwork, text, branding, and software, is owned by or licensed to Sleep Hush and is protected by intellectual property laws. All rights not expressly granted are reserved.

7. User Feedback

If you submit feedback or suggestions, you grant us the right to use them without restriction or compensation to you.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLEEP HUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Termination

We may suspend or terminate access to the Service if you violate these Terms or if required for security, legal, or operational reasons. You may stop using the Service at any time.

11. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. We will update the “Last Updated” date above. Continued use of the Service after changes become effective means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of United States, without regard to conflict of laws principles, except where applicable law provides otherwise.

13. Apple-Specific Terms

If you downloaded the App from Apple’s App Store, you acknowledge that Apple is not responsible for the App and has no obligation to provide maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation.
